Protecting a spouse's right to occupy the
home.
If the partners to a marriage are
owner-occupiers, it is often the case that
only one of them is the actual owner. If
this is the case, the other spouse will need
to ensure that s/he keeps her/his right to
live in the property and to prevent the
owner selling it without her/his knowledge.
Even if s/he actually moves out when the
relationship ends, s/he may want to move
back in again with the children.
To retain her/his right, s/he must
register her/his 'right of occupation' by
completing a form and sending it to either
the District Land Registry or the Land
Charges Depatment.
