Mothers aged under
16.
A young woman aged under 16 who has a
baby has the same legal rights and
responsibilities towards the child as any
other mother.
Benefits.
If the parents of a young mother living
at home are claiming income support or
income-based jobseeker's allowance, both she
and her child can be included in the claim.
If the young mother's parents are receiving
any of these benefits, they will also be
able to claim a social fund maternity
payment or grant for her and the child. If
they are claiming housing benefit, they can
include both her and her child in their
claim.
Education.
Local education authorities have a duty
to ensure that all children under 16 receive
an education. If a schoolgirl becomes a
mother, this duty remains.
Housing.
A young mother will not normally be able
to obtain privately rented or council
accommodation because she is too young to be
granted a tenancy. She will usually,
therefore, live with her parents. However,
she can contact the local authority social
services department and ask it to
accommodate her, provided her parents agree.
Maintenance.
A young mother can apply to the Child
Support Agency for a maintenance assessment
to be carried out in respect of her child.
Fathers aged under 16.
A father aged under 16 may wish to take
formal steps to establish a relationship
with his child, for example, by applying for
a parental responsibility agreement,
residence order or contact order.
Maintenance.
A young person aged under 16 who fathers
a child can be pursued by the Child Support
Agency for maintenance. Once the Agency is
satisfied that he is the father, he will be
expected to make maintenance payments when
he begins earning or receives a benefit.
