Court orders
Someone whose relationship is ending or has
ended, and who is or has been married, can
apply to a court to order the partner or
former partner to pay maintenance to
her/him.
In some circumstances, the court can also
make an order for child maintenance to be
paid.
A court can make an order for periodical
maintenance payments to be made,
that is, a specific sum at regular
intervals, or for a specified lump sum.
A person who wants to apply to a court for
maintenance for her/himself or for a child
should obtain the help of a solicitor. Legal
aid may be available when making an
application, but it may also be necessary to
contribute to the costs from the proceeds of
any financial arrangements made. |
